JSC "Kazakhstan Center for Public-Private Partnership" (hereinafter - PPP Center) is actively involved in the development and maintenance of the Kazakhstan legislation in the field of public-private partnerships.

Between the years 2011-2014 was developed and adopted a number of amendments to the Law of the Republic of Kazakhstan "On concessions", providing a range of new financial and legal mechanisms:

  1. New types of concession agreements
  2. One and two-stage tenders
  3. Protection of public concession commitments on curtailment
  4. Direct agreement with creditors
  5. Access fee and others

At the same time some amendments were also introduced to the Budget and Tax Codes, legislation on natural monopolies, a set of bylaws was developed.

In 2015 a completely new law on public-private partnership was adopted that was developed with the involvement of PPP Center.

The new law provides for the removal of restrictions on the areas of application PPP, extends subjective composition of the PPP, enhances the role of the private sector in the initiation and preparation of PPP projects.

At the same time a package of regulations is being developed that govern the procedure for the planning and implementation of PPP projects with the use of competitive dialogue, PFI improved competitive procedures.
